Oklahoma State sues New Mexico State over Pistol Pete mascot

There's only room for one Pistol Pete in the college football realm. 

Oklahoma State is suing New Mexico State University for plagiarizing their mascot, reports Lysee Mitri of KRQE News

Oklahoma State's lawsuit, filed in federal court on Monday, says the Aggies' mascot is confusingly similar to its own. Oklahoma State claims it had the mascot Pistol Pete first and trademarked it, then NMSU copied it. 

The lawsuit also says Oklahoma State already issued a cease-and-desist order to NMSU, but the school hasn't complied.

Pistol Pete is based on a real 1880s cowboy named Frank Eaton who used to practice his shooting skills in Oklahoma. He is said to have won a legendary gunfight later in Albuquerque, hence the connection to NMSU.
