Judge dismisses fantasy sports lawsuit against MLB, Astros, Red Sox
Federal judge Jed Rakoff dismissed the lawsuit daily fantasy sports bettors filed against Major League Baseball, the Houston Astros, and the Boston Red Sox for alleged losses the sign-stealing scandal caused, according to Daniel Wallach of The Athletic.
While the judge said the Astros "shamelessly broke" rules forbidding technology to be used while deciphering signs, Rakoff rejects that those actions could create a "cognizable legal claim," according to the 32-page ruling Wallach obtained.
Rakoff dismissed the suit "with prejudice," meaning the plaintiffs can't submit an amended claim against MLB or either team.
The league office investigated sign-stealing allegations against both the Astros and Red Sox this offseason. While the Astros' investigation has been completed and published - resulting in suspensions to AJ Hinch and Jeff Luhnow, the forfeiture of draft picks, and a $5-million fine - the probe into the Red Sox has yet to be released.
Commissioner Rob Manfred said in late March that the Red Sox investigation is complete, but added there's been "a delay in terms of producing a written report" due to the COVID-19 pandemic. The report's findings are expected to be released before play resumes.
Several other lawsuits have been filed against the Astros after their cheating scandal. The team is also facing legal action from its season-ticket holders, and former major-league pitcher Mike Bolsinger is claiming damages for his career earnings.
